On Medshop.One there are mainly products for professionals, specialists, most of the products are disposable, hygienic, pharmaceutical, medical devices, medical and laboratory products, apparatus, tools and specialized devices, configurable, manufactured, imported, manufactured components and parts, checked, set, calibrated, registered, issuing certificates, documents made to the customer's order, submitted or produced to order, are not returnable. Returns can be carried out if the seller did not meet the quality conditions (sending a defective product). The customer has the right to apply for its return or complaint, depending on the type of product.

EFFECTS OF CANCELLATION

If you cancel your order, we will reimburse all payments received from you for the goods purchased and will also reimburse delivery charges for the least expensive type of delivery offered by us. This reimbursement will be made without undue delay and, except in the situations described below, by no later than 14 days from the day on which we received your communication on the cancellation of this order. For such reimbursement we will use the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You will only have to pay compensation for any deterioration of the goods if the value of the goods diminishes due to the handling of the goods (except when it was necessary to establish the nature, characteristics and functioning of the goods).

EXCEPTIONS TO THE RIGHT OF CANCELLATION

The right to cancellation does not exist or lapses, as the case may be, in the case of contracts regarding:

• the delivery of goods which are not suitable for return due to health protection or hygienic reasons if unsealed by you after delivery, or which, due to their nature, are, after delivery, inseparately mixed with other items;

• the delivery of sealed audio or video recordings or of sealed software if unsealed by you after delivery;;

the supply of goods made to customer specifications or clearly customized to personal needs;

the supply of goods which may deteriorate or expire rapidly;

a service fully performed by Medshop (e.g. by delivery, assembly, service) with your express consent before placing the order, if you were informed before the commencement of the service that after the service is fully performed, you will lose the right to withdraw from the contract;

dthe supply of digital content (including apps, digital software, audiobooks, ebooks, PDF, MP3, etc.) which is not supplied on a tangible medium (e.g. on a CD or DVD) if you expressly accepted before your order has been executed and at the same time confirmed that we could start to deliver the content, and that you could not cancel it once delivery had started;

the delivery of newspapers, journals or magazines with the exception of subscription contracts; and

delivery of products made to order, the price of which was agreed upon concluding the sales contract, and the delivery of which may take place only after 30 days and whose value depends on market fluctuations over which we have no influence.

Due to the specificity of medical products, specializations, order fulfillment, most products are shipped under the customer's order. Only products with signs or graphics indicating 24h, 48h, 72h, 96h delivery or marked with the "by ONE" service can be delivered directly from the distribution warehouse in the same country, but this does not mean that these products can also be returned, example: "HIV rapid test", medical pump, catheter.

Products made manually to the customer's order, such as anatomical models or phantoms.

Medical device folded and manufactured according to customer configurations. e.g. furniture, laboratory autoclave or microscope.

OUR VOLUNTARY RETURNS GUARANTEE

In addition to your statutory rights, Medshop.One provides you with the following voluntary returns guarantee:

Products from sold by Medshop.Onecan be returned within 30 days of receipt of the products to Medshop.Oneif none of the exceptions applies, and if the products are complete and are in the same condition as upon receiving. Additional information can be found in help service page. 

The return of products should be made via the Form in the tab, My Account> return center

This voluntary returns guarantee does not apply to digital products or software which are not supplied on a tangible medium (e.g. on a CD or DVD).

If you return products according to this voluntary returns guarantee, we will refund to you the purchase price already paid by you, but not the delivery costs of your initial purchase. Likewise the transport risk and return costs are borne by you. The costs of delivery and return are only refunded for returns of clothing or shoes from our sites. This returns guarantee does not affect your statutory rights and therefore does not affect your right of cancellation as described above.

STATUTORY WARRANTY RIGHTS::

In addition to your 30-day returns guarantee, customers in the European Union have statutory warranty rights for a period of two years from the delivery of the goods and can request repair or replacement of the goods purchased at Medshop.One if these goods have defects or are not as described. If the goods cannot be repaired or replaced within a reasonable time or cannot be repaired or replaced without difficulties you can claim reimbursement or a reduction of the purchase price.

In the case of used goods the warranty period can be shorter than two years.

PRICING

All prices are inclusive of legally applicable VAT.

Despite our best efforts, a small number of the items in our catalogue may be mispriced. We will verify pricing when processing your order and before we take payment. If we have made a mistake and a product's correct price is higher than the price on the website, we may either contact you before dispatch to request whether you want to buy the product at the correct price or cancel your order. If a product's correct price is lower than our stated price, we will charge the lower amount and send you the product.

PAYMENT, RETENTION OF TITLE, DIRECT DEBIT, PURCHASE ON ACCOUNT

You can pay the purchase price by payment on account (under the conditions set forth in this section 5), credit card or direct debit.

Every good delivered remains property of Medshop.One EU SARL until payment has been fully made.

Payment by direct debit:

In case of a direct debit return imputable to the customer, Medshop.One will charge a lump sum damage of 3 EUR ("direct debit return fee"). The customer is entitled to prove that a damage has not occurred at all or is substantially lower than the lump sum claim.

The foregoing rules also apply to direct debits for the purpose of paying purchases made via 3rd party sellers (see Sec. 11 and 12 of the Terms of Use).

If you are a new customer there is a maximum amount up to which a purchase on account is possible. This maximum amount applies to your entire account and takes into consideration outstanding payment from earlier orders on account.

Payment on account is only available to consumers of at least 18 years of age. The delivery address, the home address and the billing address and must be located in the country where the Medshop market 's and service operate. Payment on account is not available for services or products delivered online (e.g. software downloads) or the purchase of vouchers. The payment amount becomes due upon receipt of the invoice. Medshop.One reserves the right to not offer certain payment methods in individual cases.

In the case of payment on account we charge a one-time fee of EUR 1.50 inclusive of applicable VAT per delivery in addition to any applicable shipping costs. You will be separately informed before placing your order if this fee is charged.

Should the payment on account – for reasons imputable to the customer – not be paid on the due date, Medshop.One will charge a lump sum damage of 3 EUR. The customer is entitled to prove that a damage has not occurred at all or is substantially lower than the lump sum claim.

In the case of payment on account and in other cases for legitimate reasons Medshop.One EU SARL will check and assess the data provided by you and exchange data with other company within the Medshop.One group and with credit agencies. For our decision on whether you can pay by payment on account we, in addition to our own data, use probabilities which we obtain from Company assessts the default risk in your country. The calculations of such probabilities are based on a scientifically recognised mathematical-statistical procedure. We also verify with these aforementioned companies the address data provided by you.

DELIVERY

Unless agreed otherwise, delivery will be made to the delivery address indicated by you. On our website you will find information on the availability of products sold by Medshop.One (e.g. on the respective product detail page). Please note that all information about the availability, shipping or delivery of a product is merely estimated information and contains approximate values and does not constitute binding or guaranteed shipping or delivery dates, unless expressly stated otherwise in the shipping options for the respective product. If we notice, while processing your order, that the products ordered by you are not available, we will inform you thereof in a separate e-mail or through our Message Center. You statutory rights remain unaffected.

If we cannot deliver to you because the goods delivered do not fit through your entrance door, front door or your staircase, or you are not found at the delivery address given by you even though the delivery time has been announced to you with a reasonable period of notice you will have to bear the cost of such failed delivery.

CUSTOMS

When ordering products from Medshop.One for delivery outside the EU, (and vice versa: from your country-continent of residence to another country-continent), you may be subject to import duties and taxes that are levied when the package reaches its specified destination. You are responsible for any additional customs clearance fees; we have no control over these charges. Customs rules vary greatly from country to country, so please contact your local customs office for further information. In addition, remember that by placing an order with Medshop.One, you are considered a registered importer and must comply with all laws and regulations of the country where you receive the products. Your privacy is important to us and we would like our international customers to be aware that cross-border deliveries are subject to opening and inspection by customs. WARRANTY FOR PRODUCTS SOLD BY Medshop.One AND LIMITATION OF LIABILITY

If a replacement is delivered to you as supplementary performance, you are obligated to return to us at our cost the goods initially delivered within 30 days. Medshop.One is liable without limitation if damage is caused by an intentional or gross negligent breach of duty by Medshop.One or one of its legal representatives or vicarious agents.

In addition, Medshop.One is liable for slight negligent breach of essential obligations. Essential are those obligations the breach of which puts at risk the achievement of the contractual purpose, or the performance of which enables the fulfillment of the contract and is regularly trusted on by you. In this case, Medshop.One however is only liable for foreseeable damage typical of the contract. Medshop.One is not liable for slight negligent breach of any other obligations than those mentioned in the previous sentences.

The aforementioned limitations of liability do not apply for damages from injury to life, body or health, for a defect after a guarantee for the condition of the product or for fraudulently concealed defects. The liability under the European Union Product Liability Act remains unaffected.

To the extent the liability of Medshop.One is excluded or limited, such exclusion or limitation also applies to the employees, legal representatives or vicarious agents of Medshop.One.

APPLICABLE LAW

These conditions are governed by and construed in accordance with the laws of the European Union (excluding its conflict of law provisions). In addition, the application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. We jointly agree to submit to the non-exclusive jurisdiction of the courts of your country, which means that you may pursue consumer protection claims in connection with these Terms of Sale in the European Union country where you reside. If you are a consumer residing permanently in the territory of the European Union, you are additionally entitled to protection granted on the basis of the mandatory provisions of the law of your country of residence.

AMENDMENTS TO THE CONDITIONS OF SALE

We reserve the right to make changes to our website, policies, and terms and conditions, including these Conditions of Sale at any time. You will be subject to the terms and conditions, policies and Conditions of Sale in force at the time that you order products from us, unless any change to those terms and conditions, policies or these Conditions of Sale is required to be made by law or government authority (in which case it may apply to orders previously placed by you). If any of these Conditions of Sale is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.

WAIVER

If you breach these Conditions of Sale and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these Conditions of Sale.

CHILDREN

We do not sell products for purchase by children. We sell children's products for purchase by adults. If you are under 18 you may only use Medshop.One with the involvement of a parent or guardian.
